Starting in May 2020, the Department of the Treasury began using this Case Management System (CMS), which allows parties and counsel/representatives to submit all transaction-related information to CFIUS through a secure web portal hosted by the Department of the Treasury.
Persons planning to file a notice or submit a declaration must create an account at ID.me, a secure online identity verification platform. An ID.me account is required in order to access the CFIUS CMS. CONFIDENTIALITY
Section 721 of the Defense Production Act of 1950, as amended, mandates confidentiality protections with respect to information filed with the Committee. It prohibits the Committee from publicly disclosing any information filed with the Committee, subject to limited exceptions. Information and documentary material filed with the Committee are also exempt from disclosure under the Freedom of Information Act, 5 U.S.C. § 552. Consistent with section 721, the Committee does not publicly confirm nor deny that a transaction has been notified to CFIUS. If the parties themselves publicly disclose documentary material or information filed with CFIUS, such documentary material or information may subsequently be reflected in the public statements of the Chairperson of CFIUS.

PAPERWORK REDUCTION ACT NOTICE
The information collected will be used for the U.S. Government to assess the effects of the transaction in question to the national security of the United States pursuant to authorities under Section 721 of the Defense Production Act of 1950, as amended. We estimate that it will take an average of 15-20 hours to complete each declaration and 116-130 hours per notice. Comments concerning the accuracy of this burden estimate and suggestions for reducing this burden should be directed to the Office of Privacy, Transparency and Records, Department of the Treasury, 1500 Pennsylvania Ave, N.W., Washington, D.C. 20220. An agency may not conduct nor sponsor, and a person is not required to respond to a collection of information unless it displays a valid control number assigned by OMB. The OMB Control Number for this collection is 1505-0121, which is currently approved through 01/31/2023.
